1 Scope and related agreements
These Hosting Terms govern managed virtual private server hosting provided by Nimbus Web Inc. ("FuseBase," "we," or "us") to the subscribing customer ("you"). They cover applications deployed and maintained through FuseBase, whether hosting is included in your subscription or purchased separately.
SaaS and managed hosting services
FuseBase provides two distinct categories of services: its SaaS platform and managed hosting services. SaaS services provide access to FuseBase platform functionality. Managed hosting services provide customer-specific virtual server environments, deployment of customer-selected supported applications, and ongoing technical maintenance.
Both categories are provided by Nimbus Web Inc. and may be accessed through the same account and included in the same subscription. The applicable plan or service description identifies the services and resources included.
These Hosting Terms govern the managed hosting component. Third-party applications remain subject to their applicable software licenses. FuseBase remains responsible for the hosting, deployment and maintenance duties it undertakes.
These Hosting Terms supplement the FuseBase Terms and Conditions. The Privacy Policy, applicable Data Processing Agreement ("DPA"), AI Supplemental Terms, and Refund Policy continue to apply to their respective subjects.
Your plan, order or agreed service description identifies the applications and hosting resources included. A separately signed agreement and its negotiated order of precedence control conflicts concerning its subject matter. Otherwise, applicable supplemental terms control solely for their specified service or subject: the EULA for proprietary software rights and its express software warranty, the Hosting Terms for hosting and maintenance expressly undertaken by FuseBase, the AI Supplemental Terms for AI functionality, and the Refund Policy for billing, cancellation and refunds. The DPA governs personal-data processing within its scope; an applicable BAA governs HIPAA-specific obligations, and mandatory international-transfer clauses retain their precedence. Third-party licenses govern rights in that software. Mandatory legal rights remain unaffected.
2 Hosting and deployment
FuseBase provides customer-specific virtual server environments under this offering. In the described Paperclip/n8n arrangement, each customer’s applications run in separate private virtual instances, and that customer’s Paperclip connects directly to that customer’s n8n. This is not a shared FuseBase agent-authoring service. A virtual server does not reserve underlying physical hardware exclusively for you. Resource allocations and additional instances are specified in your plan or order.
You initiate supported one-click application deployment through FuseBase. We provision the hosting environment, deploy the selected supported application, and manage ongoing technical maintenance, including application updates. You do not need to open or administer a separate cloud infrastructure account for this managed service.
Customers ordinarily access their applications while FuseBase administers the VPS. Standard application access does not include server administrator credentials, ownership of the underlying infrastructure, or an unrestricted right to install software. Requests for a different administration arrangement are addressed in section 5.
The application catalog may expand over time. Each deployment remains subject to the applicable software license, supported configuration, plan entitlements, and any application-specific conditions disclosed before deployment. Inclusion of an application in these terms does not itself establish availability or a right to deploy every edition or feature.
3 Maintenance and support
FuseBase handles technical administration, deployment, ordinary scheduled application updates and maintenance, and ordinary application deletion within the agreed hosting scope. Routine server administration is handled by FuseBase. The service description identifies included support, resources and any existing response commitments; these terms add no support SLA or guarantee of immediate installation of every upstream release.
We may install updates and security fixes, adjust configurations, and restart services as reasonably necessary to maintain the managed environment. We may use supported versions selected for security and compatibility rather than installing every upstream release immediately. Maintenance can temporarily interrupt availability or affect integrations. We will give reasonable advance notice of planned maintenance expected to materially interrupt your service when practicable; urgent security or stability work may require action without advance notice.
Our maintenance responsibilities cover the hosted environment and supported applications. Custom workflow development, business-process redesign, customer-requested modifications, and administration of separately connected accounts are included only when expressly agreed. Customer responsibilities for AI-generated content do not transfer FuseBase's expressly undertaken deployment or maintenance duties to you.
Availability, restoration times, and recovery points are governed by any applicable service-level agreement or other express commitment. These Hosting Terms do not introduce a new numerical uptime or recovery guarantee or reduce an existing agreed one.
4 Resources and charges
Your plan or order specifies applicable resource and usage allowances, which may include processing capacity, memory, storage, traffic, application instances, or execution limits. Hosting included in a subscription remains subject to those allowances. Additional applications or workloads may require an agreed change of plan or resources.
Where limits are reached, we may apply disclosed limits or discuss an upgrade. Additional charges require the pricing and authorization applicable to your plan or an approved quote; these terms do not independently authorize undisclosed overage charges.
Hosting does not automatically include third-party subscriptions, premium software features, AI model usage, external APIs, proxies, or other separately charged services. The applicable service description identifies what is included. Services connected through your own accounts are billed under your arrangements with those providers.
Renewal, payment, cancellation, and refund arrangements remain subject to your agreement and the applicable Refund Policy, including any rights that cannot lawfully be excluded.
5 Additional technical services and server access
Requests outside included deployment, ordinary scheduled maintenance/updates, ordinary deletion and agreed support may be offered as additional paid services. Examples include expedited updates, special technical assistance, custom access or configuration, custom backups, migration and a transfer-of-administration arrangement. Ordinary cancellation or deletion, and assistance required by the DPA, agreement or law, do not depend on purchasing such services.
Such requests are subject to technical feasibility and team availability. FuseBase will confirm the proposed scope and applicable fees or charging basis for your approval before beginning chargeable work. Submitting a request does not itself incur a fee. Any chargeable assessment must also be agreed in advance.
Before enabling direct server administration, we will agree the scope of access and any resulting changes to maintenance, support, security responsibilities, or charges. Until that arrangement takes effect, FuseBase continues to administer the VPS under the standard managed service. Customer-made changes may affect compatibility or support; the agreed arrangement will explain how such issues are handled.
Additional services do not change the deployment, maintenance, or support already included in your plan, or allow us to charge separately for work already required by your agreement or applicable law.
6 Customer use and connected services
You determine the business purposes for which you use an application, the users you authorize, the information you submit, and the connected accounts and instructions you approve. This includes instructions issued through AI agents. You are responsible for the permissions and lawful basis necessary for those activities and for reviewing configurations and outputs appropriate to your use.
Use only credentials and accounts you are authorized to connect. Review the relevant provider's terms, data-handling arrangements, and charges. Follow applicable software licenses and service restrictions, and do not use the hosting service for unlawful access, infringement, malware, abuse, or attempts to bypass access restrictions or resource controls. Access by your clients or other third parties must fall within the scope of your plan and applicable software rights.
FuseBase remains responsible for the hosting, maintenance, and processing it controls under the applicable agreements. Customer acknowledgment of deployment does not transfer our own software licensing or data-protection obligations to you.
7 Customer data and infrastructure
As between you and FuseBase, you retain your rights in Customer Data, subject to applicable third-party rights and the existing agreements. Hosting does not transfer ownership of application software, provider materials, or FuseBase infrastructure to you.
Hosted data may include application content, configurations, workflow definitions, execution records, connection information, and operational logs, depending on the application. We process that information to provide, maintain, support, and secure the services in accordance with the applicable agreements. Personnel access for administration and support remains subject to the confidentiality and access requirements of those agreements.
Microsoft Azure is FuseBase's primary infrastructure provider. Secondary AWS use and other service-specific providers are described in our Third-Party Services disclosures. Locations and onward processing depend on the agreed deployment and connected services. These terms do not promise that all applications, copies, or external integrations operate in one provider or region.
The DPA governs personal data processed on your behalf. Processing of account and service information for FuseBase's own purposes remains governed by the applicable Privacy Policy and DPA provisions. A software publisher is not necessarily a recipient of hosted data; actual telemetry, support, licensing, and external service connections determine whether information is shared. Applicable subprocessor agreements, notices, and objection rights remain in effect.
8 AI and regulated information
The AI Supplemental Terms apply when AI features or agents are used with hosted applications. Review whether the selected application, provider, and configuration are suitable for your intended use. For FuseBase-managed AI, that review can use our service documentation, provider disclosures, and agreed scope. For your own provider accounts, review the applicable arrangements directly with that provider.
Hosting an application does not automatically place every workflow, integration, or data category within FuseBase's security-assurance or regulatory scope. Health information may be used only within the services and configuration expressly agreed under the DPA and, where required, an executed BAA. Permission for storage alone does not authorize AI processing or onward disclosure outside that scope. Other DPA data restrictions continue to apply unless expressly varied through an appropriate written agreement.
9 Backups and recovery
Backup coverage, frequency, retention, and restoration arrangements are governed by the applicable DPA, service description, and any separately agreed recovery commitments. These Hosting Terms do not reduce existing backup or security commitments or create an additional archival service.
Available recovery depends on the affected data, available backups, and agreed service scope. Maintain any additional copies required for your business continuity needs where permitted. That precaution does not relieve FuseBase of its own agreed backup, security, or recovery duties.
10 Export and cancellation
Deleting or ending one hosted application does not itself close your FuseBase account, end your other services or reduce the price of an included subscription bundle. Separately purchased recurring charges follow their purchase terms. Ending that application’s processing is subject to the DPA’s return/deletion choice and applicable instructions, including backup obligations. Whole-account termination retains the existing DPA account/backup deadlines. Suspension of access does not remove required data-return assistance. These terms do not create a new deletion deadline, backup period or export grace period for individual applications.
You may request an export of your application data or assistance exporting an instance. Export scope and format depend on the application, technical configuration, and applicable software rights. Any additional migration, conversion, or destination setup work outside your included service is subject to section 5. Export or return already required by the DPA, your plan, or applicable law remains governed by those obligations.
Request an export while the service remains active and before deletion occurs. We will identify the available method and coordinate any requested assistance within the applicable retention limits. This does not create an additional post-termination storage period or authorize retention beyond the DPA. Exported software remains subject to its license, and receiving providers may require new accounts or credentials.
Cancellation takes effect under your subscription or order terms. On expiry or termination of the relevant hosting entitlement, access to the VPS and hosted applications ends, subject to any applicable return obligations or agreed transition arrangements. Retention and deletion, including logs and backups containing personal data, remain governed by the DPA and applicable law. Any agreement to continue hosting during a transition must be established before the relevant entitlement expires.
11 Service protection and changes
Subject to the applicable agreements, FuseBase may restrict or suspend affected functions where reasonably necessary to address security threats, unlawful or abusive use, material license violations, nonpayment, or risks to the service. Where practicable and appropriate, we will notify you, explain the affected service, and give an opportunity to resolve the issue. Urgent protective action may occur first.
Changes in upstream software support, licensing, or technical requirements may require an application update, replacement, migration, or discontinuation. We will provide notice of material service changes as required by your agreement and applicable law and, where practicable, explain available transition options. Changes remain subject to applicable contractual remedies and data-return obligations. This section does not authorize undisclosed charges or expand your rights in third-party software.
12 Application licenses and specific conditions
Each hosted application remains subject to its applicable license and notices. These Hosting Terms govern FuseBase's hosting services and do not replace third-party licenses, remove rights those licenses grant, or grant rights FuseBase is not authorized to provide. We retain applicable notices and fulfill obligations arising from our own deployment, modification, or distribution activities. Application names identify the relevant software and do not imply publisher endorsement or partnership.
Paperclip
For the Paperclip application from paperclipai/paperclip, the applicable MIT license and included notices govern the covered software. Connected agent tools, models, and provider accounts may have separate terms and charges. You determine the tasks, permissions, connected accounts, and spending authorizations assigned to your agents and review their actions and results as appropriate. Hosting does not itself include every external agent or model subscription.
Firecrawl
The self-hosted Firecrawl project is primarily licensed under AGPL-3.0, with some components under separate licenses, as identified in the project documentation. Required license notices and any applicable corresponding-source availability remain part of the software arrangements; these Hosting Terms do not restrict those rights.
You are responsible for identifying sources you are entitled to access and for the lawful collection and use of retrieved information, including applicable privacy, intellectual-property, and website access requirements. Hosting does not grant permission to access restricted material. The supported self-hosted configuration may differ from Firecrawl's own cloud offering. External APIs, proxies, and model usage are included only when specified in your plan or order.
n8n
Any n8n deployment is subject to the license applicable to its edition and version and any applicable service agreement. Customer-private Paperclip and n8n instances connect directly in the described arrangement; Paperclip’s license does not grant rights in n8n. Hosting, direct application access, workflow creation or modification through customer-local tools or MCP/API, and any downstream access must fall within the applicable rights. These Hosting Terms grant no unsupported licensing assurance.
A separate VPS, customer-initiated deployment, or administrator-access arrangement does not independently grant additional software rights. Customer acceptance of these Hosting Terms does not establish or replace permission required for FuseBase's offering. This section is not an n8n sublicense or a representation that a commercial n8n arrangement has been obtained.
Additional applications
Additional applications may be offered under these Hosting Terms when their applicable licenses and service conditions are identified. Any material application-specific conditions will be provided with the service description before deployment. An application listing does not promise perpetual availability, identical features across editions, or unrestricted third-party use.
13 Liability and general provisions
The applicable agreement's warranty provisions, liability limits, indemnities, governing law, and dispute-resolution terms continue to govern. These Hosting Terms do not introduce a separate liability cap or additional customer indemnity. Nothing in them excludes rights or obligations that cannot be excluded under applicable law, reduces applicable data-protection obligations, or removes FuseBase's expressly agreed hosting and maintenance duties.
14 Updates and contact
Material changes to these Hosting Terms will be communicated and take effect in accordance with the applicable agreement and law. Changes to a service's processing arrangements remain subject to the DPA's requirements. The applicable version and effective date will identify the terms offered for acceptance.
